Apple Pay Terms

Introduction

These Terms and Conditions govern your use of eligible cards issued by our issuing partners (each, a “Payment Card”) when you add, attempt to add, or keep a Payment Card in the Apple Pay™ wallet (“Wallet”) on any iPhone®, iPad®, or other mobile device (“Device”) that supports the Wallet.
These Terms and Conditions also augment existing agreements and represent your agreement with Decaf, Inc. (“Decaf”, “we”, “our”, or “us”) and our issuing partners regarding the use of your eligible card account with the Apple Pay service. Within these Terms, “you”, “your”, or “user” refer to the member whose name is located on the Payment Card or any authorized user of the Payment Card.
Enrolling your Payment Card into the Apple Pay service constitutes acknowledgement and agreement to these Terms. These Apple Pay Terms are provided electronically, are considered “in writing,” and are available to you in a form you may keep at decaf.so.

Relationship to Apple

Apple Pay is a service offered exclusively by Apple using eligible Apple devices. Decaf and its issuing partners do not own, operate, or control Apple Pay (including the Wallet), and are not responsible for any services or content provided to you by Apple or third parties. We are also not liable for any failure or performance of the Apple Pay service.
Your use of Apple Pay is also subject to Apple’s own terms and agreements. Apple, Apple Pay, and Wallet are trademarks of Apple Inc.

Relationship to Other Agreements

Your enrollment in Apple Pay does not affect any other agreement between you and Decaf. The terms of your Payment Card agreement remain in full effect. Any transaction made using Apple Pay will be treated the same as if using your physical card, including all fees, limitations, and applicable interest rates.

Eligibility

To use Apple Pay with your Decaf Payment Card, your account must be in good standing and not restricted by Apple, your wireless provider, or any related third party.

Device Eligibility

Only eligible Apple devices may be used. Devices that have been modified or "jailbroken" are not permitted. Use of an ineligible device constitutes a breach of these Terms and may result in suspension of your Payment Card within Apple Pay.

Fees

Decaf does not currently charge fees for using Apple Pay. Standard card fees, as outlined in your Payment Card agreement, still apply. Your carrier, Apple, or other third parties may apply additional fees.

Suspension of Payment Card

We may suspend or cancel your Decaf Payment Card in Apple Pay at any time for reasons including fraud, loss, or theft of your Device, or legal/regulatory changes.

Electronic Contact

You consent to receive electronic communications about Apple Pay at the email address associated with your Decaf account. It is your responsibility to keep your contact details up to date.

Data Privacy

You agree that Decaf may collect, transmit, and use certain data about you and your use of Apple Pay. This data is governed by the privacy policy linked to your Decaf account. Apple and third parties (e.g., Mastercard) may also collect and manage data, which is outside of Decaf’s control and governed by their respective privacy policies.

Indemnity

You agree to indemnify and hold harmless Decaf and its issuing partners from any claims, losses, or liabilities arising from your use of Apple Pay or your breach of these Terms.

Limitations of Liability & Disclaimer of Warranties

You are responsible for the maintenance, operation, and security of your device and Apple Pay credentials. Decaf disclaims any liability for device failures, security issues, or data breaches except where prohibited by law.

Termination or Change

We may amend or terminate these Terms or your access to Apple Pay at any time, subject to applicable law. Your continued use of Apple Pay constitutes acceptance of any changes.

Your Responsibilities

Enrollment: You agree to follow Apple and Decaf’s procedures for enrolling your Payment Card. Not all cards or devices may be supported.
Lost or stolen devices: Notify us immediately if your device is lost or compromised. Failure to do so may result in financial liability for unauthorized transactions.
Security: Keep your Apple ID, passwords, and device secure at all times. Sharing access credentials is done at your own risk.
Account ownership: You represent that all information provided is accurate and that you are the legal owner of the accounts and devices used.

General Terms

Definitions
  • “Apple Confidential Information” means all confidential information related to Apple, Apple Pay, or Apple customers, including roadmaps, terms, and customer data.
  • “Apple Pay” is Apple’s payment platform enabling payments using digital card credentials via Apple products.
  • “Apple Pay Service” includes card provisioning, transaction processing, and all associated capabilities in supported territories.
  • “Applicable Law” refers to all relevant legal and regulatory requirements governing Decaf and its affiliates.
  • “Cardholder” means an individual or entity issued a Payment Card by our issuing partners.
  • “Eligible Card” refers to cards offered in connection with Decaf’s card program.
  • “Enabled Device” is a supported Apple device used for storing or transmitting payment credentials.
  • “Governmental Authority” includes any relevant domestic or foreign regulatory body.
  • “Issuing Partners” are financial institutions issuing cards in partnership with Decaf.
  • “Program Manager” means Decaf, Inc.
  • “Provisioned Card” is a card added to an Apple Pay-enabled device for contactless use.
